By downloading, accessing, or using Boom or Bust, you agree to these Terms of Use. If you do not agree, do not use the app.
We may update these Terms. Continued use after changes means you accept the updated Terms. Material changes will be noted with a new "Last updated" date.
Boom or Bust is a community map for hunting garage sales, estate sales, pop-ups, thrift/pawn finds, and related places. Users may report sales, rate stops (Boom / Bust), filter the map, plan trips, and (on paid plans) use additional tools described in the app.
The app is not a classifieds personals service, dating app, escort directory, delivery marketplace, or payment escrow. Do not use it as one.
Paid tiers (Plus / Pro) and prices are shown in the app and/or App Store. Billing, renewal, and cancellation for Apple purchases are handled under Apple's terms and your Apple ID settings. Features may change; some capabilities remain in development or beta.
You may submit content including sale reports, pin details, Boom / Bust ratings, flags, and trip names. You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as needed to operate and improve the app.
You represent that you have the rights to submit the content and that it does not violate law or these Terms.
We may remove content, ban accounts, and report suspected exploitation or trafficking to law enforcement and relevant platforms (including Apple) without prior notice.
Report abuse in-app when tools are available, or via support@getboomorbust.app.
Community pins and tips are user-generated and may be wrong, outdated, or unsafe. You are solely responsible for whether you visit a location, your personal safety, and interactions with others you meet. We do not background-check users. Meet in public during daylight when possible. We are not liable for user conduct offline.
The app may show OpenStreetMap tiles, Google Places data, and hand off navigation to Apple Maps, Google Maps, Waze, or similar. Those services have their own terms and privacy policies. Availability and accuracy are not guaranteed.
The app's software, branding, and our original content are owned by us or our licensors. You may not copy, reverse-engineer (except where law forbids such restrictions), or resell the app except as permitted by the App Store license.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY VISIT TO A LOCATION DISCOVERED THROUGH THE APP.
Our aggregate liability will not exceed the greater of (a) amounts you paid us for subscriptions in the 12 months before the claim or (b) USD $50, if permitted by law. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum allowed.
You agree to indemnify and hold us harmless from claims arising out of your content, your misuse of the app, or your violation of these Terms or applicable law.
We may suspend or terminate access immediately for violations of §6 or other material breaches. You may stop using the app at any time. Provisions that should survive (license to content already distributed, disclaimers, limitations) will survive termination.
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict of law provisions, subject to mandatory consumer protections in your jurisdiction.

We take reports of child sexual exploitation and trafficking seriously and may preserve and disclose data when we believe in good faith that disclosure is reasonably necessary to comply with law or protect persons from imminent harm.
If you obtained the app from the Apple App Store, these Terms are between you and Boom or Bust only — not Apple. Apple has no obligation to furnish maintenance or support. Apple is a third-party beneficiary of these Terms solely for purposes of enforcing them against you. Refunds and subscription management for Apple purchases are handled under Apple's policies.
